Terms of Service

Foddie is a personal tracking tool, not a medical device. Nothing in the app constitutes medical advice. Please read the health disclaimer in Section 6 carefully.

1. Acceptance

By downloading, installing, or using Foddie, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the app.

These Terms constitute a legally binding agreement between you and Foddie, based in Portugal.

2. Description of Service

Foddie is a personal gut health tracking application that allows you to log meals, symptoms, stress levels, and other health-related data. The app provides AI-powered analysis to help identify potential dietary patterns and triggers based on the data you enter.

Foddie may offer guided programs (such as low-FODMAP elimination or SIBO reintroduction protocols) to assist with structured dietary management.

3. Accounts

To use Foddie, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must be at least 16 years old to use Foddie. By creating an account, you confirm that you meet this age requirement.

4. Subscriptions

Available plans

Foddie offers paid subscription plans on a monthly and yearly basis. Current prices are displayed in the App Store or Google Play before purchase. Prices may vary by country or region.

Free trial

We may offer a free trial period. If you do not cancel before the trial period ends, your selected subscription will automatically begin and your account will be charged. You can cancel at any time during the trial without being charged.

Billing and automatic renewal

Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the renewal date. Payment is charged to your Apple ID or Google Play account at confirmation of purchase and at the beginning of each renewal period.

Managing your subscription

Subscriptions are managed through your App Store or Google Play account settings. Foddie cannot directly cancel or modify your subscription on your behalf.

  • iOS: Settings > [Your Name] > Subscriptions
  • Android: Google Play > Profile > Payments & subscriptions > Subscriptions

Cancellation and refunds

Cancelling your subscription stops future renewals. You retain access to premium features until the end of the current paid billing period. We do not issue refunds for unused time remaining in the current period, except where required by applicable law (including your statutory rights as an EU consumer).

Refund requests for purchases made through the App Store must be submitted to Apple. Refund requests for purchases made through Google Play must be submitted to Google.

Price changes

We will notify you in advance of any price changes. For subscriptions renewed through the App Store or Google Play, Apple and Google will also notify you directly. Your continued use of the service after the price change takes effect constitutes your acceptance of the new price.

5. Acceptable Use

You agree not to:

  • Use Foddie for any commercial purpose without our prior written consent
  • Attempt to reverse-engineer, decompile, copy, or redistribute any part of the app
  • Submit false, misleading, or harmful data that could compromise the service
  • Use the service in any way that violates applicable local, national, or international law
  • Attempt to gain unauthorised access to any part of the service or its infrastructure

6. Health Disclaimer

Foddie is not a medical device and does not provide medical advice.

The content, analysis, and program recommendations provided by Foddie are for personal informational purposes only. They are generated based solely on the data you enter and do not take into account your complete medical history or individual health circumstances.

Foddie does not diagnose, treat, cure, or prevent any disease or medical condition. The insights generated by the app are not a substitute for professional medical advice, diagnosis, or treatment from a qualified physician, gastroenterologist, dietitian, or other healthcare professional.

Always seek the advice of a qualified healthcare professional before making changes to your diet or medical treatment, especially if you have a diagnosed medical condition.

7. Intellectual Property

All content, design, code, and technology in Foddie — including but not limited to the app interface, brand, logo, and analysis engine — is owned by or licensed to Foddie and is protected by applicable intellectual property laws.

Your personal diary data belongs to you. We do not claim ownership over the content you create within the app. You grant us a limited licence to process your data solely for the purpose of providing the service as described in our Privacy Policy.

8. Availability and Changes to the Service

We strive to maintain Foddie's availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Foddie shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use Foddie, including but not limited to loss of data or health-related decisions made based on app content.

Our total cumulative liability to you shall not exceed the total amount you paid for the service in the 12 months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Portugal.

If you are a consumer resident in the EU, you also benefit from any mandatory protective provisions of the law of your country of residence.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notification at least 15 days before they take effect. Your continued use of Foddie after that date constitutes your acceptance of the updated Terms.

If you do not agree with the updated Terms, you may cancel your subscription and delete your account before the changes take effect.
